These Terms & Conditions (Terms) are a binding agreement between you and Hampshire Holdings Intl LLC, a Florida limited liability company doing business as Life Policy Help (Life Policy Help, we, us, or our), governing your use of lifepolicyhelp.com, our landing pages, forms, telephone numbers, and text messaging (collectively, the Service).

Please read Section 14 carefully. It requires most disputes to be resolved by individual binding arbitration and waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days.

We are not an insurance company. Life Policy Help is an advertising and lead generation service. We do not sell, solicit, negotiate, bind, or service insurance, and we give no insurance advice. We connect you with licensed insurance agencies, who pay us for that connection.

1. Acceptance of these Terms

By accessing the Service, submitting a form, calling a telephone number we advertise, or replying to a text message from us, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Who we are and what we do

Life Policy Help operates consumer information websites and paid advertising campaigns relating to life insurance. When you request information, we transfer your inquiry, and route your telephone call, to one or more licensed insurance agencies that have contracted with us to receive such inquiries.

  • We are not an insurance carrier, insurance agency, insurance producer, agent, or broker. We hold no insurance license and require none, because we do not sell or solicit insurance.
  • We do not issue policies, underwrite risk, bind coverage, collect premiums, or pay claims.
  • We are compensated by licensed insurance agencies on a per-call or per-lead basis for delivering your inquiry to them. We receive no commission from any policy you may purchase. This compensation may influence which agencies receive your inquiry and in what order.
  • We are not affiliated with or endorsed by any government agency, Medicare, the Social Security Administration, or any insurance carrier.

3. Eligibility

You must be at least 18 years old, a resident of the United States, and legally able to enter into a binding contract. The Service is not directed to anyone under 18. By using the Service you represent that you meet these requirements.

4. The Service is free to you and is not an offer of insurance

We charge you nothing. Any information, rate range, coverage figure, illustration, or estimate shown on the Service is general information for comparison purposes only. It is not a quote, an offer, a binder, a contract, or a guarantee of coverage, price, availability, or eligibility. Only a licensed insurance producer, and ultimately an insurance carrier through its underwriting process, can quote, offer, or issue coverage. Actual rates and eligibility depend on underwriting, your state of residence, and carrier requirements, and will differ from any figures shown.

Nothing on the Service is insurance, legal, tax, or financial advice. Consult a licensed professional before making a decision about coverage.

5. Your obligations when you submit information

You agree that:

  • All information you provide is true, accurate, current, and complete, and relates to you.
  • The telephone number you provide is a number you own or are the customary user of, and you have the authority to consent to being contacted at that number.
  • You will notify us promptly if that telephone number is reassigned or is no longer yours.
  • You are not submitting information on behalf of another person without their authority, and you are not submitting information for testing, monitoring, litigation, or investigative purposes without disclosing that fact to us.
  • You will not use the Service to harvest data, generate automated submissions, or submit false or fictitious information.

Submitting false information, or a telephone number you do not have authority to provide, is a material breach of these Terms.

6. Consent to be contacted

By submitting a form or calling a number we advertise, and by checking or clicking the consent language displayed on that page, you provide prior express written consent to be contacted by Hampshire Holdings Intl LLC d/b/a Life Policy Help and by the licensed insurance agencies identified in that consent language, at the telephone number and email address you provided, by telephone call, artificial or prerecorded voice message, text message, and email, including through the use of automated telephone dialing systems and automated texting technology, regarding insurance products and related offers.

  • Consent is not a condition of any purchase.
  • Message and data rates may apply; message frequency varies. Reply STOP to opt out of texts, HELP for help.
  • You may revoke consent at any time by any reasonable means. See Section 5.2 of our Privacy Policy. We process revocations within 10 business days and maintain an internal Do Not Call list.
  • Revoking consent with us does not automatically revoke consent given to a licensed insurance agency that already received your information; contact them directly.

7. Calls may be recorded

Telephone calls to and from numbers we advertise may be monitored and recorded for quality assurance, training, compliance, and dispute resolution. You will be notified at the start of the call. By continuing the call after that notification, you consent to the recording. If you do not consent, tell the representative and end the call.

8. Third-party agencies, agents, and carriers

The licensed insurance agencies, agents, and carriers we connect you with are independent third parties. They are not our employees, partners, joint venturers, or agents, and we do not control them.

  • We do not endorse, recommend, guarantee, or warrant any agency, agent, carrier, policy, rate, or representation they make.
  • We do not verify, and are not responsible for, the accuracy of statements they make to you, the suitability of any product they recommend, the terms of any policy, or their handling of claims.
  • Any transaction you enter into with them is solely between you and them. We are not a party to it.
  • We are not responsible for their privacy or marketing practices once your information has been transferred to them.

If an agency or agent contacts you improperly, tell us at the contact details in Section 20. We investigate every complaint and terminate buyers who violate our requirements.

9. Intellectual property

The Service and its content, including text, layout, graphics, logos, and the Life Policy Help name and branding, are owned by Hampshire Holdings Intl LLC and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You may not copy, reproduce, scrape, frame, republish, or create derivative works from the Service without our prior written consent. Third-party names appearing on the Service are the property of their owners and their use does not imply affiliation or endorsement.

10. Prohibited conduct

You may not: use the Service for any unlawful purpose; submit information about another person without authority; use automated means to access, scrape, or index the Service except for standard search engine crawling; attempt to gain unauthorized access to the Service or its systems; interfere with or disrupt the Service; introduce malicious code; reverse engineer any part of the Service; or use the Service to compete with us or to build a competing product or dataset.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT ANY INFORMATION IS ACCURATE OR COMPLETE, THAT YOU WILL BE CONTACTED BY ANY PARTICULAR AGENCY, OR THAT YOU WILL BE OFFERED OR APPROVED FOR ANY INSURANCE PRODUCT AT ANY PARTICULAR RATE OR AT ALL.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAMPSHIRE HOLDINGS INTL LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hampshire Holdings Intl LLC and its members, managers, officers, employees, and agents from any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys fees, arising out of or relating to: your use of the Service; your breach of these Terms; information you submitted that was inaccurate, false, or that you lacked authority to provide, including any telephone number you did not own or have authority to consent for; or your violation of any law or the rights of any third party.

14. Dispute resolution binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

14.1 Informal resolution first

Before initiating any arbitration or lawsuit, you agree to first send a written Notice of Dispute to [[email protected]] or to the address in Section 20, describing the dispute and the relief you seek, including your name, the telephone number at issue, and your contact details. We will do the same before initiating a claim against you. The parties will attempt in good faith to resolve the dispute for 60 days after the notice is received. This informal process is a condition precedent to filing arbitration.

14.2 Agreement to arbitrate

Except as stated in Section 14.5, any dispute, claim, or controversy arising out of or relating to the Service, these Terms, our Privacy Policy, any communication you receive from us or from a party to whom we transferred your information, or the relationship between us including claims under the Telephone Consumer Protection Act, state telemarketing or mini-TCPA statutes, and state privacy statutes will be resolved by final and binding individual arbitration, and not in court, before a single arbitrator.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. The arbitration will be conducted by telephone, by videoconference, on written submissions, or in Broward County, Florida, at your election. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except as provided in Section 14.3. The arbitrators award may be entered as a judgment in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act.

14.3 Class action and jury trial waiver

YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that partys individual claim. If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in court, and the remaining claims will proceed in arbitration. A court, not an arbitrator, decides the enforceability of this paragraph.

14.4 Your right to opt out of arbitration

You may opt out of this arbitration agreement by sending written notice within 30 days of the date you first used the Service, to [[email protected]] or the address in Section 20, stating your name, the telephone number you provided, and that you opt out of arbitration. Opting out will not affect any other part of these Terms and will not affect your use of the Service in any way.

14.5 Exceptions

Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights. Nothing here prevents you from filing a complaint with a government agency.

14.6 Time limit

To the extent permitted by law, any claim relating to the Service must be brought within one year after it arises, or it is permanently barred.

15. Governing law and venue

These Terms and any dispute arising from them are governed by the laws of the State of Florida, without regard to its conflict of laws rules. For any claim not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida, and waive any objection to that venue.

16. Electronic communications and E-SIGN consent

By using the Service you consent to receive communications from us electronically, including by email and text message, and you agree that electronic communications, agreements, notices, and disclosures satisfy any legal requirement that they be in writing. You consent to the use of electronic signatures and agree that clicking a button, checking a box, or submitting a form constitutes your signature. You may withdraw this consent by contacting us, though doing so may prevent us from providing the Service.

17. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. Sections 8 through 20 survive termination.

18. Changes to these Terms

We may modify these Terms at any time. The Last updated date reflects the most recent version. Material changes will be posted on the Service before they take effect. Your continued use after changes take effect means you accept them. If you do not agree, stop using the Service.

19. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. Except for the indemnified parties named in Section 13, these Terms create no third-party beneficiary rights.
Headings. Headings are for convenience only and do not affect interpretation.
